School Prize Terms and Conditions

 

SANITARIUM HEALTH FOOD COMPANY “SANITARIUM WEET-BIX KIDS TRY-ATHLON 2012” SCHOOLS PROMOTION

As a result of adverse weather the original Logan Brisbane event was postponed to a later date. In reliance upon clause 13, the Promoter has revised the conditions as set out below in clause 5 to add an additional replacement event at Logan Brisbane on 24 June 2012.

TERMS AND CONDITIONS

1. Information on how to enter and prizes form part of these Terms and Conditions.

2. Open to academic/educational schools in Australia. Non-education systems are ineligible.

3. To be eligible, school students, aged 7-15 years inclusive (as at the date of the relevant event) must be registered to participate in the Sanitarium Weet-Bix Kids TRYathlon 2012 Series Event in their State/Region (the “Event”). As part of the registration process, the school student’s name and their school should be submitted. Registrations must be received at the Kids TRYathlon Registration Centre by the “School Prizes Closing Date” for their Event (specified in clause 5 below) to be valid (“Registered Students”). Registrations that are illegible, incomplete, or that contain spelling errors may be deemed invalid. Students may still be eligible to register after the School Prizes Closing Date, however, their registration will not contribute towards the school total in the school prize competition. The winning school/s must take the prize during the prize period as outlined below.

4. The Promoter accepts no responsibility for late, lost or misdirected registration forms.

6. There will be three (3) prizes awarded at each Event that takes place.

7. Prize determination: the school with the highest average of Registered Students in the Sanitarium Weet-Bix Kids TRY-athlon for a particular Event, based on the number of Registered Students who provided the name of their school at time of registration, divided by the number of students enrolled at that school will win the 1st placed prize of a $1,000 Rebel Sport Gift Card plus a VIP area at the relevant Event. The schools with the 2nd and 3rd highest average of Registered Students in the Sanitarium Weet-Bix Kids TRY-athlon for a particular Event, based on the number of Registered Students who provided the name of their school at time of registration, divided by the number of students enrolled at that school will win the Runner Up prize of a VIP area at the relevant Event. The VIP area will consist of a 3m x 3m marque tent set up for the school at the relevant Event. Each school acknowledges that the Promoter will be using school enrolment information as reasonably obtained by the Promoter through various sources as determined by the Promoter.

8. A school may not win more than one (1) prize per Event.

9. In order to determine the winner(s) of prize(s), if there is a tie between two or more schools for a specific prize, the tied schools will be notified following the registration close date for their Event of the tie, and will be required to answer in writing (email accepted) in fifty (50) words or less, why their school should win the relevant prize. Submissions close at 5pm on the third working day immediately after they have been notified of the tie. The best answer, as determined by the Promoter in its absolute discretion, will be deemed the winner. Judging will be based on literary and creative merit.

10. The winning schools for each prize will be contacted by phone. Promoter’s decision is final and no correspondence will be entered into.

11. The Promoter accepts no responsibility for any variation in the prize values. Prizes are not transferable or exchangeable and cannot be taken as cash. If a school does not wish to take the prize, they will not be offered an alternative.

12. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification.

13. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any school or entrant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

14. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (f) any tax liability incurred by a winner or entrant; (g) use of a prize or participating in the prize; or (g) if there are any differences between the actual numbers of students in the school and the numbers of students as reasonably obtained by Sanitarium for the purpose of determining the winners.
